Terms of Service (EULA)

Apple Standard Licensed Application End User License Agreement

By downloading or using the AirChat application, you agree to be bound by the following standard terms, which supplement or replace any other terms in accordance with Apple’s guidelines.

1. Scope of License

Licensor grants to you a nontransferable license to use the Licensed Application on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.

2. Consent to Use of Data

You agree that Licensor may collect and use technical data and related information to facilitate software updates and product support. Since AirChat operates entirely offline, no personal communication logs or analytics are ever collected.

3. Termination

The license is effective until terminated by you or Licensor. Your rights will terminate automatically if you fail to comply with any of these terms.

4. Offline Communication Disclaimer

AirChat is a local peer-to-peer network application. Connectivity depends on physical proximity, regional signals, and the presence of active neighboring nodes.

5. NO WARRANTY

USE OF THE APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS.

6. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY OR INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE APPLICATION.

7. Legal Compliance

You represent and warrant that (i) you are not in an embargoed country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this EULA and have the right to enforce this agreement.

9. Subscription Terms & Billing

Optional Premium Features & Service Tiers

  • AirChat Premium Subscription plans:
    • Yearly Access: $19.99/Year. You can cancel your subscription at any time.
    • Monthly Access (with Trial): $1.99/Week, with a 3-day free trial period. You can cancel your subscription at any time.
  • This pricing is for United States customers. Pricing in other countries may vary and actual charges may be converted to your local currency depending on your country of residence.
  • Payment will be charged to your iTunes Account at confirmation of purchase.
  • The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be clearly identified.
  • Subscriptions may be managed by the user, and auto-renewal may be turned off by going to the user's Account Settings after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
  • You can manage your subscription and switch off the auto-renewal by accessing your Application settings after purchase.
  • You cannot cancel the current active subscription during its running subscription period.
